Data controller

The controller of your personal data is OpenBytes Patryk Gruszka, ul. Lipowa 3D, 30-702 Krakow, Poland, VAT EU number PL6472546732. For questions about your data, email contact@openbytes.pl.

Data, purposes and legal bases

When you send an email, I process your email address, subject, message and any other data you voluntarily include. This data is used to answer your enquiry, conduct discussions before entering into a contract and, where applicable, perform that contract.

The legal basis is taking steps at your request before entering into a contract or performing a contract (Article 6(1)(b) GDPR). In other cases, it is the legitimate interest in handling correspondence and protecting against legal claims (Article 6(1)(f) GDPR).

Website analytics

On the production website, I use Matomo hosted on my own account to measure visits and how the website is used. Matomo receives the visited page address, referring page and technical browser and device data, while the server receiving the request also processes the IP address. Tracking does not use cookies and respects the browser's Do Not Track setting. The data is used only to create aggregate statistics and improve the website, without advertising profiling. The legal basis is the controller's legitimate interest in analysing the website's effectiveness (Article 6(1)(f) GDPR).

Recipients and international transfers

Data may be entrusted to hosting, email and IT service providers only to the extent required to operate the website and handle correspondence. Data is not sold. If a provider processes data outside the European Economic Area, the transfer relies on a mechanism required by the GDPR, in particular an adequacy decision or Standard Contractual Clauses.

Retention

Correspondence is retained for the time needed to handle your enquiry and then until any related claims expire. Data connected with a contract may be kept longer where tax or accounting law requires it.

Your rights

You may request access to, rectification or erasure of your data, restriction of processing and, where applicable, data portability. You may object to processing based on legitimate interests. You also have the right to lodge a complaint with the President of the Polish Personal Data Protection Office or your local supervisory authority.

Providing data

Providing data is voluntary, but an email address and message are necessary to receive an answer. Your data is not used for automated decision-making or profiling.
